This person is incorrect. Regardless of your account size if you do 3 daytrades in a rolling 5 day period you are marked a pattern day trader. Your account is only restricted if it is under 25k though. In other words you can do as many day trades as you want without a restriction but you will hit pdt. Last I heard 25K was the threshold.

Accounts over 25k aren't flagged automatically. Once you do more than 3 day trades in a 5 business day period, the account is officially flagged.
